2. Important: not an emergency or medical service
The Website and the information on it are provided for general information, guidance and signposting only. It is not an emergency service, and it is not medical, psychiatric, legal or other professional advice.
- If you or someone else is in immediate danger, call 999.
- For urgent medical help, call NHS 111 or contact your GP.
- If you are in distress and need to talk now, you can call Samaritans on 116 123 (free, 24 hours).
Please do not use the Website’s forms, email or social media to ask for urgent help, as we may not see your message straight away. Nothing on the Website creates a clinical, counselling or professional relationship between you and us, and you should seek advice from a suitably qualified professional about your own circumstances.
3. Using the Website
You may use the Website for lawful purposes only. You must not:
- use it in any way that breaks any law or regulation;
- try to gain unauthorised access to the Website, our servers, or any connected system;
- introduce viruses, malware or other harmful or disruptive material;
- collect or harvest data from the Website by automated means without our written permission;
- submit false, misleading, abusive, threatening or defamatory content, or content that infringes anyone else’s rights;
- impersonate any person or organisation, or misrepresent your connection with us;
- use the Website to send unsolicited marketing or spam.
We may suspend or restrict access to the Website, or remove content, if we reasonably believe you have broken these Terms.
4. Information on the Website
We take reasonable care to keep the information on the Website accurate and up to date, but we do not promise that it is complete, accurate or current. Information about services, opening times, contact details and referral routes may change. Please check with the relevant organisation directly before relying on it. We may update, change or remove content at any time without notice.
5. Links to other websites and organisations
The Website links to, and describes, other organisations and services, such as Andy’s Man Club and Change Grow Live. These are independent of us. Unless we say otherwise, we do not control them, and a link or mention is not an endorsement or a guarantee of the quality, availability or suitability of their services. We are not responsible for their content, privacy practices or services, and you use them at your own risk and subject to their own terms.
6. Donations
6.1 Making a donation. You can make a donation through the Website using our payment provider, woopayments, stripe, and paypal. By donating you confirm that you are at least 18 years old and that the donation is made from your own funds (or you are authorised to donate them).
6.2 Payment processing. Payments are processed securely by our payment provider under its own terms and privacy policy. We do not see or store your full card details.
6.3 Use of donations. Donations are used to further our charitable purposes, which can be different things, e.g. providing support, guidance and signposting to people facing mental health challenges, addiction and difficult life circumstances. Unless you tell us otherwise before donating, we may apply your donation wherever the need is greatest. If you wish to restrict how your gift is used, please contact us first. If a restricted appeal raises more than is needed or cannot be fulfilled, we will use the surplus for similar purposes within our charitable objects.
6.4 No refunds. Donations are generally non-refundable. If you believe a donation was made in error or without your authority, please contact us within 14 days and we will consider your request in good faith.
6.5 Regular giving. If you set up a regular donation, you may cancel it at any time by contacting us or your payment provider. Cancellation takes effect for future payments only.
6.6 Donation acknowledgements. We may email you a receipt or thank you for your donation. We will contact you about fundraising only in line with your preferences and our Privacy Policy.
6.7 Fraud prevention. We may refuse or return a donation where we have reasonable concerns about its source, in line with charity law and our gift acceptance policy.
7. Volunteering, fundraising and partnerships
Expressions of interest in volunteering, fundraising or partnering with us made through the Website are not offers of a role, contract or employment, and we are not obliged to accept them. Any volunteer role will be subject to our own selection, checks and policies, and to a separate volunteer agreement or role description where appropriate. If you fundraise in our name, you must follow our fundraising guidance and applicable law (including the Fundraising Regulator’s Code of Fundraising Practice), and you must not suggest that we are responsible for your event.
8. Content you send us
If you send us comments, stories, testimonials, photos or other material, you confirm that you own it or have permission to share it, and that it does not infringe anyone’s rights. You give us a non-exclusive, royalty-free licence to use it for our charitable purposes. We will always ask your permission, and agree how to credit you or keep you anonymous, before publishing any story or photo that identifies you or anyone else, and you may withdraw your consent for future use at any time. Please do not post other people’s personal or sensitive information on the Website.
9. Intellectual property
The Website and its contents, including text, logos, graphics, design and layout, belong to us or our licensors and are protected by copyright, trade mark and other intellectual property laws. Some images may be used under licence from third parties. You may view, download and print pages for your own personal, non-commercial use, or to share information about our work, as long as you do not alter them and you acknowledge us as the source. Any other use, including copying for commercial purposes, requires our written permission. “Here to Help” and our logos are our trade marks.
10. Our responsibility to you
10.1 What we do not exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
10.2 Website provided “as is”. Subject to 10.1, we provide the Website on an “as is” and “as available” basis. We do not promise that it will always be available, uninterrupted, secure or free from errors, viruses or other harmful components.
10.3 Limits on liability. Subject to 10.1, we are not liable for any loss or damage arising from your use of, or inability to use, the Website, or from your reliance on any information on it, including indirect or consequential loss, loss of data, or loss of income or profit. We are also not responsible for the acts, omissions or services of any third-party organisation we link to or refer you to.
10.4 If you are a consumer, your statutory rights are not affected by these Terms.
11. Privacy and cookies
We handle your personal data as set out in our Privacy Policy, and we use cookies as set out in our Cookies Policy. Please read both. Information about your health or personal circumstances is treated as confidential in line with our Privacy Policy.
12. Safeguarding
We take safeguarding seriously. If you tell us something that suggests a child or an adult at risk may be in danger of harm, or that you are at serious risk, we may need to share that information with the appropriate authorities, as explained in our Privacy Policy.
13. Changes to these Terms and the Website
We may change these Terms from time to time, for example to reflect changes in law or in how we operate. The updated version will be posted on this page with a new “last updated” date, and the changes will apply from then. Please check this page regularly. By continuing to use the Website after changes are posted you accept the updated Terms. We may also change, suspend or withdraw any part of the Website at any time.
14. General
- Entire agreement. These Terms, with our Privacy Policy and Cookies Policy, are the whole agreement between you and us about the Website.
- If part is unenforceable. If any part of these Terms is found to be invalid or unenforceable, the rest remains in force.
- No waiver. If we do not enforce a right straight away, it does not mean we give it up.
- Third parties. Nobody other than you and us has any right to enforce these Terms.
- You may not transfer your rights under these Terms to anyone else. We may transfer ours to another organisation that continues our charitable work.
15. Governing law
These Terms, and any dispute or claim arising out of them or your use of the Website, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in the courts of your home country.
16. Complaints and feedback
We want to hear if something has gone wrong or if you have feedback. Please contact us at info@here-to-help.co.uk, and we will try to respond within 2 working days. Where relevant, you can also contact the Charity Commission for England and Wales or the Fundraising Regulator about our fundraising.
